This Privacy Policy applies to http://www.fmsystems.com and https://portal.fmsystems.com (“Websites”) owned and operated by FM:Systems Group, LLC (formerly FM:Systems, Inc., collectively, “FM:Systems”, “We”, “Us”, or “Our”). This Privacy Policy describes how FM:Systems collects, uses, shares and secures the personal information (“personal data”) you provide on our service application (FM:Interact® Hosted Solutions) and our Websites, as well as the personal data transferred to us for processing on behalf of our customers. It also describes your choices regarding use, access and correction of your personal information. This online privacy policy applies only to information collected through our Websites and service application — not to information collected offline.

EU-U.S. & Swiss-U.S. Privacy Shield

FM:Systems participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework. FM:Systems is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, FM:Systems is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, FM:Systems may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website, https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

FM:Systems has further committed to cooperate with the EU data protection authorities (DPAs) for EU employees, and the Swiss Federal Data Protection and Information Commissioner for Swiss employees, with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU or Switzerland, respectively, in the context of the employment relationship and employee data that it processes in its role as a service provider.

What information do we collect or receive?

FM:Systems collects certain personal data from individuals through their use of our service application and our Websites. For example, we collect personal data from you when you register on our site, subscribe to our newsletter, respond to a survey or fill out a form.

When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address or phone number. You may, however, visit our Websites without telling us who you are or providing us with any personal data.

With respect to the personal data that FM:Systems collects from you, FM:Systems acts as the controller of your personal data. In this capacity, we only collect, use, share, store, or otherwise process your personal data when we have an appropriate basis. For example, we may process your personal data as necessary to provide services that are subject to terms you have accepted, such as our end user license agreements or terms of service. We may process your personal data when necessary to comply with legal obligations or for purposes of pursuing legitimate interests (such as providing products and services, improving the services and the Websites, performing internal analytics, preventing fraud, enforcing legal claims, and security purposes) if doing so is consistent with your rights and appropriate to the context.

FM:Systems also processes personal data under the direction of our Clients. In those instances, FM:Systems acts as a processor of the personal data of its Client, the data controller. For example, we may obtain Client contacts from our tools such as Salesforce in order to personalize newsletters, advertising, and other content and special offers. We may transfer such personal data to certain companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Clients. When we collect information under the direction of our Clients, we have no direct relationship with the individuals whose personal data we process. If you have provided personal data to one of our Clients and would no longer like to be contacted by the Client that uses our service, please contact the Client that you interact with directly.

Because we have no direct relationship with the individuals whose personal data we process under the direction of our Clients, an individual who seeks access to, or who wishes to rectify, erase, or restrict processing of his or her personal data should direct his or her query to the FM:Systems Client (the data controller). We will make every effort to respond to the requests that we receive in a timely manner.

We may receive information about you from other sources or third parties from whom we have purchased data, and combine this data with information we already have about you. This helps us to update, expand and analyze our records, identify new customers and prospect employees, and provide products and services that may be of interest to you. If you provide us personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us. Examples of the types of personal information that may be obtained from or purchased from third parties and combined with information we already have about you may include purchased marketing data about our customers from third parties that is combined with information we already have about you, to create more tailored advertising and products and updated job title and contact information for prospect employees.

Collection and Use of Third-Party Personal Data

You may also provide personal data about other people, such as their full name, email address and phone number. This information is only used for the purpose of completing your business partner registration or for whatever reason it may have been provided. Tracking Technologies

As is true of most web sites, we gather certain information automatically and store it in log files. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We do link this automatically collected data to other information we collect about you.

FM:Systems and our partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Users can control the use of cookies at the individual browser level.

We use cookies for marketing purposes and customizing the user experience. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.

We partner with a third-party ad network to either display advertising on our website or to manage our advertising on other sites. When we act as the controller of your personal data, we retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

When we act as a processor of our Clients’ personal data, we will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Client. FM:Systems will retain this personal data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

How do we protect your information?
