EU-U.S. & Swiss-U.S. Privacy Shield
With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, FM:Systems is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, FM:Systems may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
Under certain conditions, more fully described on the Privacy Shield website, https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.
In compliance with the Privacy Shield Principles, FM:Systems commits to resolve complaints about our collection or use of your personal information. FM:Systems has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved Privacy Shield complaints concerning data transferred from the EU and Switzerland.
What information do we collect or receive?
FM:Systems collects certain personal data from individuals through their use of our service application and our Websites. For example, we collect personal data from you when you register on our site, subscribe to our newsletter, respond to a survey or fill out a form.
When ordering or registering on our site, as appropriate, you may be asked to enter your: name,username, e-mail address, mailing address or phone number. You may, however, visit our Websites without telling us who you are or providing us with any personal data.
With respect to the personal data that FM:Systems collects from you, FM:Systems acts as the controller of your personal data. In this capacity, we only collect, use, share, store, or otherwise process your personal data when we have an appropriate basis. FM:Systems also processes personal data under the direction of our Clients. In those instances, FM:Systems acts as a processor of the personal data of its Client, the data controller. For example, we may obtain Client contacts from our tools such as Salesforce in order to personalize newsletters, advertising, and other content and special offers. We may transfer such personal data to certain companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Clients. When we collect information under the direction of our Clients, we have no direct relationship with the individuals whose personal data we process. If you have provided personal data to one of our Clients and would no longer like to be contacted by the Client that uses our service, please contact the Client that you interact with directly.
Because we have no direct relationship with the individuals whose personal data we process under the direction of our Clients, an individual who seeks access to, or who wishes to rectify, erase, or restrict processing of his or her personal data should direct his or her query to the FM:Systems Client (the data controller). We will make every effort to respond to the requests that we receive in a timely manner.
We may receive information about you from other sources or third parties from whom we have purchased data, and combine this data with information we already have about you. This helps us to update, expand and analyze our records, identify new customers and prospect employees, and provide products and services that may be of interest to you. If you provide us personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us. Examples of the types of personal information that may be obtained from or purchased from third parties and combined with information we already have about you may include purchased marketing data about our customers from third parties that is combined with information we already have about you, to create more tailored advertising and products and updated job title and contact information for prospect employees.

As is true of most web sites, we gather certain information automatically and store it in log files. When we act as the controller of your personal data, we retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
When we act as a processor of our Clients’ personal data, we will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Client. FM:Systems will retain this personal data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

How do we protect your information?
We implement a variety of security measures to maintain the safety of your personal data when you enter, submit, or access your personal data.
